Peel Harbour Facilities Order 2005 - Notice of Proposal 29 July 2005

    NOTICE of a Proposal to Make the PEEL HARBOUR FACILITIES ORDER 2005 in respect of the facilities provided by the Department within the inner harbour of Peel Harbour

    In accordance with section 58A(5) and (6) of the Harbours (Isle of Man) Act 1961 the Department gives notice that it has prepared a draft for the Peel Harbour Facilities Order 2005 the effect of which is set out below.

    In accordance with section 58A(1) of the Harbours (Isle of Man) Act 1961 the Department of Transport considers it necessary for the development, improvement regulation and management of Peel Harbour that an order under Section 58A should be made in respect of the facilities provided by the Department in the inner harbour to the effect that section 58 of the Harbours (Isle of Man) Act 1961 shall not apply to that area of Peel Harbour. Accordingly, the Department would not be obliged to make the facilities in the inner harbour available equally to all persons on payment of the appropriate dues and may therefore in accordance with section 58A(2) appropriate the inner harbour and the associated facilities:-

    (a) for the exclusive or preferential use of a particular user; or

    (b) for a particular class of vessel, traffic or use.

    In accordance with section 28A(3), the Department has satisfied itself that the proposed Order and any use envisaged for the inner harbour and the associated facilities will not prejudice –

    The safety of navigation in Peel harbour; or
    The safety of operations as respects the inner harbour and the associated facilities or any other facility provided by the Department.

    A draft of the Order may be inspected free of charge, during ordinary office hours, at Peel Harbour office and at the Sea Terminal Offices of the Department, Douglas, The draft Order may also be viewed on the Harbours Division Website at www.gov.im/harbours/allnews.gov. Any objections to the draft Order may be made to the Department in writing, such objections to be addressed to the Chief Executive of the Department of Transport and submitted in an envelope clearly marked “PEEL HARBOUR FACILITIES ORDER”. Objections so submitted should be delivered to the Sea Terminal Offices of the Department by no later than Thursday, 1st September 2005.
