Negotiations are currently taking place to bring about the transfer of responsibility for all of the services for children presently provided by Manx Family Services to other service providers. These are being led for the Department by Peter Smallridge, Interim Director of Social Services.

In the course of the discussions Peter Smallridge, has made it clear that he wants to ensure that the principles of “T.U.P.E.”, Regulations that protect the rights of employees when services are transferred from one provide to another, would apply to all staff whose employment would change, except where there are outstanding disciplinary matters or child protection issues in respect of any individual.

In the course of the discussions to date, Peter Smallridge had offered this assurance to the Chief Executive of MFS with a request that it be made known to the staff of the company.

The precise arrangements of the transfer are yet to be finalised but remain a key issue for Social Services Directorate.

Note: What is TUPE?

The Transfer of Undertakings (Public Employees) Regulations 1981 and 2006, which are known as TUPE. These regulations, and amendments, implement the European Community Acquired Rights Directive 1977.
