Guidance for CSPs providing services to companies registered under the Companies Act 2006 7 November 2006

The Financial Supervision Commission has issued a Guidance Note in respect of its expectations of corporate service providers who provide services to companies registered under the Companies Act 2006, including acting as a registered agent.

The Guidance Note covers the responsibilities of registered agents and corporate directors as well as continuing anti-money laundering obligations. The Guidance Note is Appendix E4 to the Fiduciaries Handbook and can be found at http://www.gov.im/lib/docs/fsc/handbooks/guides/csps/cspappendixe4.pdf and reference to it has been incorporated into the Fiduciaries Handbook by amendment to Section 3.5 (“Ongoing regulatory requirements for fiduciary businesses”).

This Guidance Note will also be relevant to fund managers and administrators should they at some date in the future manage or administer funds that are established as 2006 Act companies.

The Commission acknowledges the co-operation of, and assistance provided by, the Association of Corporate Service Providers in drafting the Guidance Note.
