Cannabis Importers Can Be Arrested 6 January 2004

In order to clarify their position, and contrary to recent reports in the Manx media concerning the legality of arrest in relation to cannabis, IOM Customs and Excise Division wish to make it clear that the power of arrest under sections 47(2) and 178(2) of the Customs and Excise Management Act 1986 remains extant.

In other words, Customs Officers' powers of arrest in respect of the import into the Island of any Class C drug will not be affected by the reclassification of cannabis from Class B to Class C.

The public should be aware that anyone bringing any such prohibited goods to the Island will continue to be dealt with by Customs using the full range of their powers.
